CANCELLATION & REFUND POLICY

for Hémera Charter

Introduction

This Cancellation & Refund Policy governs all bookings made through:

By completing a reservation through the Platform, customers acknowledge and accept this Policy in full.

This Policy applies to:

  • boat rentals,
  • yacht charters,
  • skippered charters,
  • bareboat rentals,
  • experiences,
  • and related services offered through Hémera Charter.

Reservation Deposit

To confirm a booking, customers may be required to pay:

  • either the full charter amount,
  • or a reservation deposit through the Platform.

Reservation deposits are considered:

non-refundable booking and reservation fees

used to secure:

  • vessel availability,
  • scheduling,
  • administrative handling,
  • and booking commitment.

Customer Cancellation Policy

More than 14 Days Before Departure

If the customer cancels more than fourteen (14) days before the scheduled charter date:

  • partial refunds may be granted,
  • excluding booking fees, administrative fees, and transaction costs.

Refund eligibility remains subject to:

  • operator approval,
  • payment provider processing,
  • and vessel-specific conditions.

Between 14 Days and 72 Hours Before Departure

If cancellation occurs between fourteen (14) days and seventy-two (72) hours before departure:

  • reservation deposits become fully non-refundable.

Additional amounts paid may be partially refundable at the discretion of the operator or Hémera Charter.

Less than 48 Hours Before Departure

If cancellation occurs less than forty-eight (48) hours before departure:

  • the booking becomes fully non-refundable.

No refunds, credits, or compensation shall be issued.

No-Show

Failure to appear:

  • at the agreed meeting point,
  • within the required boarding time,
  • or with legally required documentation,

shall be considered a no-show.

In such cases:

  • the booking is automatically cancelled,
  • and no refund shall apply.

Late Arrival

Customer delays do not extend:

  • charter duration,
  • reserved timeslot,
  • or return schedule.

Operators may shorten or cancel the experience when delays significantly impact operational scheduling.

No refund shall be granted for lost time caused by customer delay.

Weather Conditions

Maritime activities are inherently dependent on weather and sea conditions.

Refunds or rescheduling due to weather shall only apply when:

  • navigation is officially considered unsafe,
  • local maritime authorities restrict departures,
  • or the operator determines that conditions present a legitimate safety risk.

The following do NOT qualify for refunds:

  • cloudy weather,
  • light rain,
  • moderate wind,
  • lower temperatures,
  • rough but navigable sea conditions,
  • seasickness concerns,
  • or changes in customer preference.

In approved weather-related cancellations, Hémera Charter or the operator may offer:

  • rescheduling,
  • voucher credit,
  • alternative vessel availability,
  • or partial/full refund.

The final decision remains at the discretion of the operator and Hémera Charter.

Operator Cancellation

In rare situations, bookings may be cancelled by:

  • the vessel owner,
  • charter operator,
  • captain,
  • or Hémera Charter.

Possible reasons include:

  • technical problems,
  • safety concerns,
  • operational issues,
  • force majeure events,
  • crew unavailability,
  • or legal restrictions.

In such cases, customers may receive:

  • a replacement vessel,
  • rescheduling options,
  • platform credit,
  • or a refund depending on the circumstances.

Hémera Charter shall not be liable for:

  • travel expenses,
  • accommodation costs,
  • transportation arrangements,
  • or indirect losses resulting from cancellation.

Force Majeure

No refunds or compensation shall be required in situations beyond reasonable control, including:

  • storms,
  • natural disasters,
  • governmental restrictions,
  • port closures,
  • strikes,
  • pandemics,
  • war,
  • civil unrest,
  • or severe technical disruptions.

Refund Processing Time

Approved refunds may require:

  • 5 to 15 business days,
  • or longer depending on banking institutions and payment providers.

Transaction fees and currency conversion costs may be deducted where applicable.

Chargebacks & Payment Disputes

Customers agree not to initiate unjustified payment disputes or chargebacks.

Fraudulent or abusive chargeback activity may result in:

  • legal action,
  • account suspension,
  • debt recovery procedures,
  • and permanent restriction from the Platform.

Modification of Reservations

Requests to:

  • change dates,
  • switch vessels,
  • modify schedules,
  • or adjust passenger information,

remain subject to:

  • availability,
  • operator approval,
  • and possible additional charges.

Acceptance of This Policy

By completing a booking through Hémera Charter, customers confirm that they:

  • have read,
  • understood,
  • and accepted

this Cancellation & Refund Policy in full.
